Remember, in the ROTS novel the duel was based off the ORIGINAL duel that was in the film. The duel we see in the film was a re-shoot and was completely different than the first version. In the first version, and in the book, he never lost the lightsaber. By the time Lucas re-shot it, it was too late to update the book.

Just after he told Anikan about him being a Sith he had the statue cut open and he took it out. So no one could pick it up until Palpatine got there and while examining the crime scene slipped it in his pocket.

You sure about that? In the Star Wars visual directory i think it said he had two. And If you notice, When he fought Fisto Mace Tiin and Kolor it is black and gold. When fighting yoda, it's white and gold.
